AndroGel Lawsuit Update: 32 Cases Selected for Early Trials
As of November 2015, more than 3,000 lawsuits have been filed against testosterone drug manufacturers in U.S. These lawsuits were all filed by men who claim that they experienced heart attacks, stroke and other cardiovascular side-effect after undergoing testosterone therapy for Low-T.
It takes a lot of time and resources to hear 3,000 legal cases. In June 2014, a multidistrict litigation (MDL) was established in the District Court, Northern District of Illinois. The MDL allows all testosterone lawsuits to be heard by one judge, Judge Matthew F. Kennelly. This saves time by removing the need for duplicate discoveries and eliminates conflicting rulings.
The next step was the choosing of bellwether cases. A bellwether case is a lawsuit that is chosen to test the arguments of the plaintiff (the victims filing the lawsuits) and the defense (the drug companies). Bellwether cases are often used when there are thousands of similar lawsuits against one party or a few related parties.
Each side selects several bellwether cases. The facts in these cases should be representative of all the cases in the multidistrict litigation. This is important, because outcomes of bellwether cases often determine the outcome of future cases. For example, if the judge rules on behalf of most of the plaintiff’s, the drug companies may decide that it is more cost-effective to offer a settlement to the men who filed lawsuits rather than continuing the fight in court.
On November 2, 2015, Judge Kennelly received a list of 16 cases each from the plaintiffs and 16 cases from the defendants. All of the cases involve lawsuits against AbbVie, the manufacturer of AndroGel. While AbbVie is not the only manufacturer of testosterone products included in the litigation, most of the lawsuits involve treatment with AndroGel. Judge Kennelly has decided that lawsuits against the manufacturer of Androgel lawsuits would provide the best guide to how future lawsuits will be decided.
As the case proceeds, each side will have the opportunity to object to cases chosen by the other side. The list of cases will be narrowed down to six bellwether trials. These cases will be heard by a jury in late 2016 or early 2017.
